1 About Warka Tree

The business has its base in Stockholm, Sweden. The post address is Honnörsgatan 21, SE-170 69 Stockholm. Requests or suggestions should be e-mailed to info@warkatree.com with your contact details. We will be in touch soon.

2 Orders

When you have placed an order, a confirmation will be sent to your e-mail. There you will find all details on products, price and billing and delivery addresses. Any errors in the confirmation should immediately be notified to info@warkatree.com.

3 Delivery

Our normal delivery times is 2 to 3 working days. Orders made on weekends will generally be processed Monday at the earliest.

If you experience delayed deliveries (which we have not informed you about), please notify us at info@warkatree.com.

4 Prices

All prices in the store are in Swedish Kronor (SEK) and all prices include 25 percent Value Added Tax (VAT). We reserve our right to change prices due to supplier issues and erroneous listing. All rights to price adjustments are otherwise reserved.

5 Return policy

The statutory 14 days return period applies, from the date you have received a product that you ordered.

5.1 Product returns

You must notify us of your intent to return a product. The notification shall be sent to info@warkatree.com. Clearly state your name, address, e-mail, order identification number and the products that should be returned. Immediately, and in any case within the statutory period of 14 days, send back the product to us.

We will pay for your return delivery. Returned products should be in original condition. Return products sufficiently packaged and preferably in the original packaging.

We reserve the right to deduct an amount corresponding to the diminished value of the product when it is returned in a damaged or used condition.

5.2 Products that cannot be returned

We will not accept returns in the following cases:

Products that have been sealed due to health or hygiene reasons and where that seal has been broken by the purchaser.

Sealed sound or video recordings or similar products where the seal has been broken by the purchaser.

Bespoke products or products that have been specially manufactured to the purchaser’s order or individual preferences.

Completed services where the purchaser has explicitly consented to the service being delivered without return possibility.

Perishable products, such as foodstuffs.

Newspapers or magazines.

6 Complaints and defective products

We will inspect all products before final delivery. In cases where products are defective or damaged or the wrong product was delivered we will take responsibility for correcting the problem without any additional cost to you, in accordance with applicable consumer protection legislation.

Any defective products or deliveries must be notified to us and accepted by us before return delivery of the product. The notification must be sent immediately after discovery of the defect.

6.1 How to notify defective deliveries Any errors or defects must be notified to info@warkatree.com. State your name, address, e-mail, order identification number and a description of the error.

In cases where we cannot correct the error or deliver an identical or essentially similar product, we will refund your costs in accordance with applicable consumer protection legislation. Return delivery will be paid for when errors or defects have been accepted.

We reserve the right to not accept return requests due to defective deliveries when the product or delivery is not defective, in accordance with applicable consumer protection legislation.

We will endeavor to apply Sweden’s National Board for Consumer Disputes (ARN) guidelines, see www.arn.se.

7 Liability limitation

We will not be held liable for indirect damages that may be caused by the product.

We do not accept liability for any non-performance caused by circumstances beyond our control, which directly or indirectly prevents, obstructs or renders production, delivery or freight uneconomical until such obstacle has been removed (force majeure). Such circumstances shall be deemed to include difficulties to procure raw materials as well as other difficulties and disturbances, including but not limited to war, riot, labour conflicts, fire, flood, storm, accident, fuel or power shortages, transportation shortages, obstacles or interruptions regarding transportation at sea and breakdowns or interruptions of any kind as regards to our equipment or facilities, which are deemed necessary for the performance of our agreements' obligations.

8 Product information

We do not accept liability for any errors on this website or limited product stocks.

We cannot guarantee that images necessarily correspond to products’ exact appearance, since minor color variations may occur due to screen, photography and resolution. We always try to expose our products as accurately as possibly.

9 Cookies information

In accordance with electronic communications legislation, website visitors shall be notified of the use of cookies.

A cookie is a small piece of data that a website asks your browser to store on your computer or mobile device. The cookie allows the website to "remember" your actions or preferences over time.

10 Data Protection Policy (GDPR)

By shopping with Warka Tree, you accept our Data Protection Policy and our processing of your personal data. We will protect your personal integrity and will not collect more personal data about you than is necessary to fulfil your order. We will never resell your data or forward it to third parties without legal authorization.

Warka Tree is responsible for the processing of your personal data collected by us. Your personal data is processed to fulfil your orders or to provide newsletters or campaign offers. This may include marketing specially adapted to your individual interests.

The following is a summary of our Data Protection Policy in accordance with the EU General Data Protection Regulation (GDPR).

10.1 What is personal data?

Personal data is all information that directly or indirectly may be connected to a natural person.

10.2 What data do we retain?

In order to fulfil your orders and answer requests (customer service) we store your full name, address, phone number, e-mail, ip address and purchase history.

Your data will be retained for as long as we have legal authorization to process that data, e.g. in order to fulfil a purchase agreement or to comply with legal obligations (such as tax or bookkeeping laws).

10.3 Legal authorization

Your personal data will be processed in order to fulfil the purchase agreement made with you.

Marketing, campaign offers and similar mailings will be made only with your consent.

10.4 Which data is processed and for what purpose?

10.4.1 Payment provider

On carrying out a purchase, data will be forwarded to our payment provider. The data retained is full name, address, e-mail and phone number. If you choose payment by invoice your personal id number will also be retained by the payment service provider. The data is retained in order to fulfil the purchase agreement and to protect against fraud.

Our payment service providers are Payson and Swish.

10.4.2 Delivery service providers

Specific data will be shared with delivery service providers in order to fulfil deliveries and purchase agreements. Data forwarded is full name and delivery address. E-mail and/or phone number may also be forwarded for delivery notification purposes.

Our delivery service providers are DHL and PostNord.

10.4.3 Newsletter

If you have chosen to subscribe to our newsletter, full name and e-mail will be forwarded to our newsletter provider. The purpose is to send marketing information and updates.

10.5 Right to access data

You have the right to receive a copy of any data retained about you. Copies will be delivered electronically in a readable format.

10.6 Right to corrections

You have the right to request an update of erroneous information or supplement information that is deficient.

10.7 Right to be forgotten

You may at any time request the deletion of any data that concerns you personally. There are a few exceptions to this right. In particular we may retain personal data that is necessary to comply with legal obligations (such as bookkeeping and tax laws).

10.8 Data protection responsibility

Warka Tree is responsible for storage and processing of your personal data and will comply with applicable regulations.

10.9 Protection of personal data

We use industry standards such as SSL/TLS and one-way hash algorithms to store, process and forward sensitive information such as personal data and passwords in a secure manner.

11 Amendments to Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time or for any reason. Amendments will be published online on the website. Amended Terms and Conditions are considered to be accepted following orders or website visits.

12 Disputes and applicable laws

In cases of disputes that cannot be satisfactorily resolved by agreement between the business and consumer, the consumer may refer the dispute to the National Board for Consumer Disputes (ARN).

Residents in other EU countries may register complaints to the EU Commission dispute mediation platform, see http://ec.europa.eu/consumers/odr.

We will implement decisions by ARN or similar dispute resolution bodies.

Disputes concerning the interpretation or application of these Terms and Conditions shall be resolved in accordance with Swedish law.
